I have examined the opinion of January 2, 1900, in the light of the decision of the court in the Fairbanks case, and have carefully considered the arguments advanced by counsel for the railroads. 1 see no reason to change the conclusion reached by AttorneyGeneral Griggs. The proper effect of the decision in the Fairbanks case is merely to eliminate the discriminating stamp tax against foreign bills of lading treated strictly as such; but a bill of lading, which is in part domestic, given for transportation within the United States as well as for export, may be taxed upon the domestic part. In my opinion, all bills of lading for goods transported by rail from place to place within the United States ought to have a 1-cent stamp attached, regardless of the ultimate destination of the goods.
